Terms of Service

These terms govern use of Berkobot's platform by business clients who connect a WhatsApp Business Account and use our scheduling, messaging, payment-link, and document-delivery features. By creating an account or using the platform, a business client agrees to these terms.

01The service

Berkobot provides software that lets a business ("you," "business client") connect its own WhatsApp Business Account (WABA) to a platform for appointment scheduling, customer messaging, payment links, and document delivery. Berkobot operates as a Meta Tech Provider: your WABA remains owned by your own Meta business portfolio, and you separately agree to Meta's own WhatsApp Business Terms and platform policies, which continue to apply alongside these terms.

Because we connect your account to WhatsApp's platform, you agree to:

04Your data and content

You retain ownership of the data you and your end users put into the platform — customer records, messages, documents, and booking data. We process that data as described in our Privacy Policy, under your instructions, to provide the service to you. You're responsible for having the right to share your end users' data with us for that purpose, including any consents required under applicable law.

If you stop using the platform, you can request an export or deletion of your data — see our Data Deletion page.

07Availability and support

We aim to keep the platform available and will give notice of planned maintenance where practical. Some functionality depends on third-party platforms we don't control — Meta's WhatsApp Business Platform, scheduling infrastructure, and payment providers — and an outage or policy change on their side may affect the service without being within our control to prevent.

08Liability

The platform is provided on an "as is" basis. To the extent permitted by applicable law, Berkobot is not liable for indirect, incidental, or consequential damages arising from use of the platform, including losses caused by an outage, policy change, or restriction imposed by Meta or another third-party provider we integrate with. Nothing in these terms limits liability that cannot be limited under applicable law.

We may update these terms from time to time. We'll update the "last updated" date above, and for material changes we'll notify business clients directly in addition to posting the update here.

11Governing law

These terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles, unless a separate signed agreement between you and Berkobot states otherwise.
